Special Education Law:
There are a variety of laws that protect disabled children in the classroom. The
Individuals with Disabilities in Education Act (IDEA), guarantees a free public
education to those who suffer from a hearing, speech, or visual impairment, a brain
injury or mental impairment, serious emotional or health issues, autism, or an identifiable
learning disability. Under the IDEA parents have the right to have their child evaluated
to find out if he or she qualifies for special education programs, see their child's
school records and testing results, and meet with meet with school representatives
to work out a plan for their child's special needs. In addition, Section 504 of
the Rehabilitation Act of 1973, as amended, is designed to protect the rights of
individuals with disabilities in programs or activities that receive Federal financial
assistance from the U.S. Department of Education. Section 504 regulations require
a school district to provide a “free appropriate public education” (FAPE) to each
qualified student with a disability who is in the school district’s jurisdiction.
